Victims of Distracted Drivers/Motorists
When we first opened our law firm in 1993, we often saw cases where a driver who is distracted by spilled coffee, kids screaming, fiddling with the radio, putting on makeup, trying to get change for a toll causing an accident. Now, we often see drivers not using hand-free cell phones or Bluetooth, or texting while driving which causes another entire level of distraction leading to additional automobile crashes. In fact, many recent studies indicate that texting while driving and distracted driving can be equally if not more dangerous than driving under the influence. If an investigating officer discovers these types of distractions, liability can likewise be easier to prove and can lead to greater damages/monetary awards/settlements.
