Our client was a 53-year old female passenger who worked at a bank. She was seat-belted when the vehicle she was a passenger in was struck in a T-bone type collision in Austust 2018.
The vehicle she was in suffered moderate impact/property damage. According to the Florida Traffic Crash Report, the at-fault commercial vehicle’s driver that caused the collision was cited for ‘FAIL TO STOP STEADY RED SIGNAL OR YIELD RIGHT OF WAY TO PED’ in violation of Florida Statute 316.075(1)(C)1.
Video was recorded of the incident and such was taken by traffic cameras and submitted to CSEU. After the collision, she sought medical care from a local urgent care facility that referred her to a chiropractor’s office for treatment.
She was later found to have an emergent medical condition (EMC). She eventually underwent an MRI of her shoulder that revealed a partial tear of the rotator cuff with fluid and edema. Other MR studies revealed disc bulges and herniations at multiple levels in the cervical spine that were either acute or aggravations/activations of pre-existing conditions.
The client then consulted with orthopedic specialists concerning her shoulder where she was administered a single steroid injection and was also prescribed NSAIDs. While she was a surgical candidate, she chose to forego surgery.
Approximately six months later, Sokoloff & Weinstein, P.A. was able to garner a pre-suit settlement in the amount of $135,000.00. .
